ملخص البحث
تناول هذا البحث الحديث عن أصول مهنة الطب في التراث الإسلامي ومدى عناية أحکام الفقه الإسلامي بحقوق المريض  ومراعاة حالته الصحية ، کما تم الحديث عن مدى مشروعية التداوي وأراء الفقهاء في الأحکام التکليفية المتعلقة به ، کما تناول البحث الأحکام المتعلقة بالحقوق والواجبات التي ينبغي توافرها للمرضى من حيث احترام الکرامة الإنسانية للمريض ،أيضا  تم الحديث عن التعريف بالمرض وبيان المقصود بالحق والواجب ، ثم تعرض البحث للحقوق التي تکفل السلامة المهنية للمريض ، وذلک من خلال أماکن العلاج ومدى سلامتها وصلاحيتها لإقامة المرضى دون ضرر عليهم ، کما تعرض البحث لحق المريض على أسراره وعدم إفشائها ووجوب استئذان المريض في المسائل العلاجية وتبصيره بالنتائج المترتبة على استخدام بعض أنواع العلاج أو العمليات الجراحية ، کما تناول البحث ممارسة مهنة الطب في الفقه الإسلامي ومدى مسئولية الطبيب عن ممارسة هذه المهنة دون علم بأصولها المهنية ومدى ضمان ما أتلفه من نفس أو عضو من أعضاء المريض0

Abstract
This paper discusses the origins of the medical profession in the Islamic heritage and the extent of the attention of the provisions of Islamic jurisprudence to the rights of the patient also talked about the definition of the disease and the statement of what is meant by the right and duty and then presented the research to the rights that ensure the occupational safety of the patient through the places of treatment and the extent of its safety and validity for the establishment of patients without harm to them as the research presented to the right of the patient on captivity and its lack of disclosure and the necessity of the permission of the patient in the treatment of issues and to help them understand the consequences of the use of certain types of medical treatment or surgical procedures the research also dealt with the practice of this profession without knowledge of its professional origins and the extent of ensuring the damage of the same or a member of the patient
