تجديد الخطاب الفقهي في ضوء التعايش المجتمعي

ملخص البحث ( عربي)
يرکز هذا البحث على إشکالية تجديد الخطاب الفقهي في ضوء التعايش المجتمعي, وإلقاء الضوء على أنه ليس أمرا جديدا على التشريع الإسلامي بل هو قديم جديد فلم تخلو منه کتب العلماء والفقهاء منذ القدم ولم يتخلف عن الحديث عنه والعمل على تطويره وتحديثه عالم أو مفکر أو مبدع ينتسب إلى الدين الإسلامي, وإن قصر المعاصرون في ذلک فليس بدليل على تخلف ورجعية الدين وعلمائه على مر السنين.
فشتان بين خطابين فقهيين: بين خطاب مليء بالدم والکراهية والعنف والنبذ والفرقة والاختلاف... يقوم على عدم الفهم الجيد لقواعد الشرائع السماوية, وعدم الدراسة المتأنية لأقوال الفقهاء, وفقد الخبرة الفقهية ببيئات الفتاوى والآراء, وانعدام الفهم الواسع لاحتياجات المجتمع وأفراده بجلب المصالح لهم أو دفع المفاسد عنهم , وبين خطاب مفعم بالتسامح والتخفيف والتيسير والمحبة والرحمة... من دارس عالم خبير هادىء عاقل مستنير, مفرق بين ما هو مصلحة وما هو مفسدة , ومميز لما يترتب على هذا أو ذاک, حريص على دفع المشاق وعلى جلب التيسير والتخفيف لأفراد المجتمع؛ بما يتناسب مع اختلاف الزمان والمکان.
وهذا البحث ينفض الغبار وينزع الغطاء عما أشکل فهمه وما أسيء إدراکه في هذا الموضوع المهم والخطير؛ وذلک بالترکيز على وضع مفهوم حديث قديم لهذا التجديد, ومحاولة ضبطه بما يقوم عليه من أرکان وسمات, وکذلک تطويره وتحديثه في ضوء الملامح والأطر الفقهية ؛ لمواکبة التطور التحضر والعالمية في ضوء التعايش المجتمعي ليس بين المسلمين وغيرهم بل مع المسلمين أنفسهم , ثم إنهاء ذلک بخاتمة فيها أهم النتائج والتوصيات .
وذلک مما قد يساعد على حل هذه الإشکالية؛ ومن ثم وضع الأمر في نصابه الصحيح وعودته إلى حده الطبيعي والتقليل من الهجوم على علماء الدين وأئمة التنوير وقادة المبدعين في الفکر الإسلامي على مر العصور والذين حملوا على عاتقهم أمانة هذا الدين والحفاظ عليه.

         This research shake the dust and take away the cover of what are confused to understand and poorly realized in this important and serious matter; and by focusing on the development of modern Old to this renewal concept, and try to adjust what it does it from the pillars and features, as well as the development and modernization in the light of the features of frameworks jurisprudence; to keep pace with the development of urbanization and global in light of societal co-existence is not between Muslims and others, but with the Muslims themselves, then exit the conclusion that the most important findings and recommendations. 
          And that which may help to solve this problem; and then put the record straight and return to the normal unit and reduce the attack on the religious scholars and imams of the Enlightenment and the leaders of innovators in Islamic thought throughout the ages, and who took it upon themselves to the secretariat of  this debt and keep it.
