أحکام جناية المسلم على غير المسلم في الفقه الاسلامي

ملخص البحث :
لا  ريب أن علم الشريعة أفضل العلوم على الإطلاق وأجلها على الدوام من تأمل فيه سره کثرة المصنفات وتنوع المعارف، وکيف لا يکون کذلک وقد حظي باهتمام العلماء المخلصين، الذين أفنوا أعمارهم في خدمته، وتلذذوا بالبحث في مسائله، وأبانوا عن جليل محاسنه، وبعد اطلاعي على کثير من الکتب الفقهية تبين لي أن هذا الموضوع متفرق في کتب الجنايات والديات، فقررت أن أسهم بجهدي المتواضع، فأتتبع مسائل هذا الموضوع وأجمعها تحت نطاق واحد لتکون متناسقة واضحة.
يحصل ليس لدى کثير من الناس في قضية التعامل مع الکفار حيث يعتقد عامة الناس أن الکفار على درجة واحدة، ولا حقوق لهم البتة، وفي هذا إجحاف لا يقره الإسلام، وفي هذا الجهد المتواضع قليل من الإشارات التي تبدد ذلک الالتباس.
وفي جملة هذا البحث تظهر للمطلع بعض المعلومات التي تدله على يسر الإسلام وسماحته وأنه دين العدل والنصح والوسط وذلک أدعى إلى استقطاب الکثرة الکاثرة من الناس للدخول في هذا الدين والعبِّ من محاسنه وفضائله.
ويتحدث المبحث الأول عن تعريف الجناية والفرق بينها وبين الجريمة من الجراح. ويتناول المبحث الثاني: عدداً من موجبات الجناية على وجه الاختصار وهي القصاص والدية والأرش وحکومة العدل والضمان والکفارة والحرمان من الإرث. وفي المبحث الثالث أبين حقيقة الکفر وأنواعه وأقسام الکفار بحسب علاقتهم بالمسلمين، وهم المحاربون، والمعاهدون، والمستأمنون، والذميون والمرتدون ونحوهم. أما المبحث الرابع ففيه بيان أحکام جناية المسلم على کل من الکفار الذين سبق بيانهم في المبحث الثالث. وفي الخاتمة أهم نتائج البحث.

There is no doubt that the science of Sharia is the best science ever, and always guided by the hope of the secret of the abundance of works and the diversity of knowledge, and how not to be so and has received the attention of sincere scholars, who died in his service, and delights in the research of his questions, and expressed the Jalil Mahasnh, Many books of jurisprudence show me that this subject is scattered in the books of crimes and religions, so I decided to contribute to my humble efforts, I follow the issues of this subject and grouped under one scope to be consistent and clear.
Many people do not have the issue of dealing with unbelievers, where the public believes that the infidels are one degree, and they have no rights at all, and this is an injustice that is not recognized by Islam. In this modest effort, there are few signs that dispel this confusion.
In this research, the reader has some information that indicates the pleasure of Islam and its permissibility, and that it is the religion of justice, advice and moderation. He claimed to attract a large number of people to enter this religion and play from its virtues and virtues.
The first section deals with the definition of crime and the difference between it and the crime of wounds.
