العملة المشفرة (البتکوين) تکييفها الفقهي وحکمها الشرعي دراسة فقهية مقارنة

تعتبر العملة المشفرة البتکوين تقنية غيرت طريقة تعامل العالم مع المال والنقود، وقد تميزت هذه العملة الناشئة والمشفرة بالغموض والجدل خلال السنوات الأولى عند ظهورها، مما استدعى تقييم تداعياتها وتسليط الضَّوء عليها.

وقد خَلُص البحث إلى أن العملات المشفرة لا يجوز التعامل بها من باب سد الذرائع؛ لاضطراب قيمتها، وتحقيقها للفوضى المالية نظرًا لما يحيط بها من غموض.
کما أنها لا تقوم بوظائف النقد جميعها حتى يصح إطلاق صفة النقد عليها، فهي تقتصر على مجموعة من الناس، وأصل النقد ما کان مقبولاً کوسيط للشراء والتعاملات المالية، بمعنى أنه يمکن أن يستخدم للشراء والبيع على نطاق واسع.
کما أن البتکوين ليس بسلعة في ذاته، فيقاس على الذهب والفضة، وإنما هو عبارة مجرد رقم تعارف بعض الناس أن له قيمة، فأشبه النقود الورقية من هذه الجهة وخالفها من جهة أن النقود الورقية اکتسبت ثقتها باعتماد الدولة لها، أما العملات المشفرة فاکتسبت ثقتها عند البعض بالوجود في الواقع.
کما أوصت الدراسة بضرورة قيام الباحثين بمزيد من الدراسات والأبحاث التي تساعد في فهم وتطوير هذه الأداة النقدية الجديدة، بحيث يمکن في النهاية العمل بها مع التقليل من سلبياتها، مع ضرورة وجود تنسيق وتعاون تشريعي دولي يعمل على وضع الأطر الکفيلة بحماية المتعاملين بالعملات المشفرة، وصياغة قوانين تضبط إصدار هذه العملات وآليات تداولها، حفاظًا على المقاصد الاقتصادية الشرعية.
