حکم النفقة على الحيوان الـمملوک

تعد النفقة على الحيوان المملوک أحد أسباب النفقة في الشريعة الإسلامية، وذلک لأن الإنسان قد يتولى مسئولية حيوان ما، فيجب عليه أن يحسن تولى هذه المسئولية بالنفقة عليه. ولأهمية الحيوان في حياة الإنسان، ومدى حاجته إليه، فقد تناول البحث حکم النفقة على الحيوان المملوک، وذلک من خلال مبحثين رئيسيين.
فأما المبحث الأول: عرض تعريف السبب والنفقة والحيوان، وقد تبين أن السبب هو الوصف الظاهر المنضبط الذي أضاف الشارع إليه الحکم ويلزم من وجوده الوجود ومن عدمه العدم لذاته، وأما النفقة فهي کفاية من يُمَونُه خبزاً أو أدماً وکسوة ومسکن وتوابعها، وأما الحيوان فهو الجسم النامي الحساس المتحرک بالإرادة. وقد اشتمل هذا المبحث على ثلاثة مطالب، ففي المطلب الأول تعريف السبب، وفي المطلب الثاني تعريف النفقة ومصدرها وأنواعها وأسبابها، وفي المطلب الثالث تعريف الحيوان وأقسامه وأهميته في حياة الإنسان.
وأما المبحث الثاني: فقد عرض حکم النفقة على الحيوان المملوک والإجبار عليها وأنواعها، وقد تبين أن حکمها الوجوب على مالکه وهذا باتفاق الفقهاء، ولو امتنع المالک للحيوان عن النفقة عليه فقد اختلف الفقهاء في إجباره عليها، هل يجبر ديانةً أم قضاءً، وقد تبين أن القول الراجح أنه يجبر عليها ديانةً وقضاءً، وأما أنواع النفقة فقد تعددت وتنوعت إلى العلف والسقي والعلاج. وقد اشتمل هذا المبحث على ثلاثة مطالب ففي المطلب الأول حکم النفقة على الحيوان المملوک، وفي المطلب الثاني الإجبار على النفقة، وفي المطلب الثالث أنواع النفقة.
وقد خلص هذا البحث إلى عدة نتائج من أهمها
-         مصدر النفقة في الإسلام هو العمل
-         أسباب النفقة ثلاثة: الزوجية والقرابة والملک
-         الحيوان متعدد النوع والشکل
-         يجب على مالک الحيوان إطعامه وسقيه وعلاجه وعلاجه
 
The expenses on the possessed animal is considered one of the expenses causes in Islamic shari . That's because the man may be responsible for an animal so, he has to be suitable for  this responsibility .
Because the animal is important in man's life and he needs it, we are studying the adjudication of the expenses of the possessed animal through two main units
The first unit, the definition of the cause, the expense and the animal. It's obvious that the clear description that the legislator added to the adjudication that is related to its existence or disappearance
As for the expense means the satisfaction of whom you bring up with clothing, housing, and food etc…
As for the animal, it's the growing and sensitive body and this unit includes three demands, the first is the definition of the cause. The is the definition of the expense, its sources, types and its causes and the third demand is the definition of  animal, its departments and its importance in life
As for the second unit, I have shown the adjudication of the expense on the possessed animal, its obligation and its types . its clear that it's a must on its owner according to all of jurists . and if the owner refuses to the expense on his animal, the jurists have different opinions on making him pay this expense . is he obliged religiously or magisterially . It's shown that the best speech is that the owner is obliged to pay expense religiously and magisterially
As for the types of the expenses varies to include silage, watering and the cure and this unit includes three demands, the first,  the adjudication of the expense on the possessed animal . the second, the obligation on the expenses and the third is the types of the expenses
And this research has reached may results such as
-the source of expense in Islam is work
-the causes of expenses is three :marriage, kinship, and theownership
-the animals varies in type and shape
-the owner of the animal has to support it with food, water, and cure
