التطبيقات الأصولية على أحاديث باب القضاء من كتاب عمدة الأحكام من كلام خير الأنام للحافظ عبد الغني المقدسي رَحِمَهُ اللهُ (ت: ٦٠٠ هـ)

موضوع البحث القواعد الأصولية والمقاصدية على أحاديث باب القضاء من كتاب عمدة الأحكام من كلام خير الأنام صلى الله عليه وسلم للحافظ عبدالغني المقدسي رحمه الله (ت: ٦٠٠هـ ) وهذا البحث يعتني باستنتاج القواعد الأصولية في أحاديث باب القضاء ودراستها ، ودراسة الأحاديث من حيث : تخريجه ، وبيان درجته ، وغريب ألفاظه ، وبيان سبب وروده إن وجد . وبدأت بذكر الحديث كما أورده المقدسي رَحمَهُ اللهُ في كتابه عمدة الأحكام . . ذكرت الروايات الأخرى التي لم يذكرها المقدسي وهي التي موجودة في الصحيحين . وأخرجت الحديث تخريج علمي على النحو الآتي : درجة الحديث، اسم المتن، اسم الكتاب والباب رقم الجزء والصفحة رقم الحديث .وبينت غريب الحديث من كتب غريب الحديث واللغة إن وجد. واستخرجت التطبيقات الأصولية مع بيان تعلقها بالحديث المدروس وذكرت القواعد الأصولية المذكورة في شروحات الأحاديث، مع عزو أقوال الشارحين للأحاديث إلى كتبهم، أو إلى الواسطة إذا تعذر الأصل وإن ذكر الشارح القاعدة نصاً فنقلتها كذلك، أما إن أشار إليها فاجتهدت في صياغتها صيغة علمية أصولية مع توثيقها من كتب الأصول أو المعاني إن كانت من حروف المعاني.
:The subject of the research is the fundamental and objective rules on the hadiths in the chapter on judiciary from the book Umdat al-Ahkam from the words of the best of the people, may God bless him and grant him peace, by Al-Hafiz Abdul-Ghani al-Maqdisi, may God have mercy on him (He died 600 Hijri) This research is concerned with deducing the fundamental rules in the hadiths in the chapter on judiciary and studying them, and studying the hadiths in terms of: their grading, An explanation of its degree, the strangeness of its words, and an explanation of the reason for its occurrence, if any. I began by mentioning the hadith as reported by Al-Maqdisi, may God have mercy on him, in his book Umdat Al-Ahkam. . I mentioned other narrations that Al-Maqdisi did not mention, which are found in the Two Sahihs. I produced the hadith in a scientific manner as follows: the degree of the hadith, the name of the text, the name of the book, the chapter number, the part, and the page number of the hadith. I highlighted the strange hadith from the books of the strange hadith and the language, if any. I extracted the fundamental applications with an explanation of their connection to the hadith studied, and I mentioned the fundamental rules mentioned in the explanations of the hadiths, while attributing the sayings of the commentators of the hadiths to their books, or to an intermediary if the original was not possible, and if the commentator mentioned the rule in text, I quoted it as well. However, if he referred to it, I worked hard to formulate it in a fundamental scientific formula and document it. From the books of principles or meanings if they are from the letters of meanings.
