تطبيقات أصولية على أحاديث كتاب النكاح من عمدة الأحكام في هدي خير الأنام للحافظ عبد الغني بن عبد الواحد المقدسي (ت600ه)

لاشك أن دراسة منهج التطبيقات الأصولية على النصوص الشرعية مما يعين الباحث على فهم النصوص فهما دقيقا، والنظر والتأمل فيها مليا، حتى يستطيع أن يطبق القواعد الأصولية على تلك النصوص، حتى يتوصل بها إلى الحكم الفقهي للمسألة محل البحث. ويهدف هذا البحث إلى إبراز أثر القواعد الأصولية في فهم النصوص الشرعية، وبيان أثر الخلاف فيها في الاختلاف في الفروع الفقهية، وفي سبيل ذلك قام الباحث بدراسة كتاب النكاح من عمدة الأحكام  لبيان هذا الارتباط الوثيق بين الفقه والقواعد الأصولية. ولما كان كتاب عمدة الأحكام من الكتب الأمهات في موضوعها، فقد ارتأيت أن أتناول أحاديث كتاب النكاح بالدراسة الأصولية التطبيقية، عن طريق إعمال منهج التطبيقات الأصولية على تلك الأحاديث، وذلك أن الدراسات التي تعنى بالدراسة الأصولية التطبيقية تقرب من فهم علم الأصول، وتيسر من استيعاب مسائله. وأن مسألة التطبيقات الأصولية على النصوص الشرعية تعتبر في نظري من أكثر المسائل التي يجب العناية بها في دراسات مستقلة، تخدم الجوانب التأصيلية، وتبين الثمرات الأصولية والفقهية. وقد انتظم هذا البحث في مقدمة وتمهيد ومبحث واحد: أما المقدمة فاشتملت على سبب اختيار الموضوع، وأهداف البحث، والدراسات السابقة، وخطة البحث، ومنهج البحث. وأما التمهيد ففي التعريف بمفردات عنوان البحث. وخصصت المبحث الأول للتطبيقات الأصولية الواردة في كتاب النكاح من عمدة الأحكام. ثم الخاتمة: وفيها أبرز النتائج. هذا والله أسأل أن ينفع به ويتقبله ويجعله خالصاً لوجهه الكريم، فإن كان صوابًا فمن عنده سبحانه وتعالى، وإن كان غير ذلك فأستغفر الله العظيم وأتوب إليه. ولا حول ولا قوة إلا بالله العلي
There is no doubt that studying the methodology of fundamentalist applications on the legal texts helps the researcher to understand the texts accurately, and to consider and meditate on them carefully, so that he can apply the principles of fundamentalism to those texts, until he reaches the jurisprudential ruling on the issue in question. This research aims to highlight the impact of the fundamentalist rules in understanding the legal texts, and to show the impact of the difference in them on the difference in the jurisprudential branches. And since the book Umdat al-Ahkam is one of the most important books in its subject matter, I decided to deal with the hadiths of the Book of Marriage with an applied fundamentalist study, by applying the methodology of fundamentalist applications on these hadiths, and that is because the studies concerned with the applied fundamentalist study bring closer to understanding the science of fundamentals, and facilitate understanding of its issues. . And that the issue of fundamentalist applications to the legal texts is considered, in my opinion, one of the most important issues that must be taken care of in independent studies, that serve the fundamentalist aspects, and show the fruits of fundamentalism and jurisprudence. This research was organized in an introduction, preface, and one topic: The introduction included the reason for choosing the topic, research objectives, previous studies, research plan, and research methodology. As for the introduction, it defines the vocabulary of the research title. The first topic was devoted to the fundamentalist applications contained in the book of marriage from the pillar of rulings. Then the conclusion: it contains the most prominent results. This is God, I ask that He benefit from it and accept it and make it pure for His honorable face.
