الحجر الصحي في زمن الأوبئة " كورونا نموذجًا"

الملخص:
الحجر الصحي إجراء وقائي لمنع انتشار الأمراض المعدية , وقد أقرته الشريعة الإسلامية أكثر من أربعة عشر قرنا؛ لمكافحة الأمراض المعدية, وهذا دليل على مدى صلاحية الشريعة الإسلامية لكل زمان ومكان, والحكمة منه تتمثل في: حفظ النفس من الهلاك , وحماية المجتمع  من انتشار المرض المعدي . والحجر الصحي في زمن تفشي الأوبئة واجب شرعا ؛ لأن حفظ النفس مقصد من مقاصد الشريعة الإسلامية, وهو من قبيل درء المفاسد ؛ لذا يجوز لولي الأمر التدخل  بسن القوانين لحفظ الرعية من الأمراض المعدية ؛ وذلك لأن تصرف الإمام على الرعية منوط بالمصلحة , ويجب على المواطنين الالتزام بالتدابير التي تحددها الجهات الرسمية في الدولة؛ منعا من انتشار المرض
Abstract :
Quarantine is a preventive measure to prevent the spread of infectious diseases. It has been approved by Islamic law for more than fourteen centuries. To combat infectious diseases, and this is evidence of the validity of Islamic law for every time and place, and the wisdom of it is represented in: preserving the soul from destruction, and protecting society from the spread of infectious disease. Quarantine during epidemics is obligatory in Islam. Because self-preservation is one of the purposes of Islamic law, and it is like warding off evil; Therefore, it is permissible for the guardian to intervene in enacting laws to protect the subjects from infectious diseases; This is because the behavior of the imam over the subjects depends on the interest, and the citizens must abide by the measures determined by the official authorities in the state.
