معالم منهج البحث الفقهي عند الإمام الجويني من خلال كتابه: (نهاية المطلب في دراية المذهب) -استقراءً وتحليلاً- في كتاب الطهارة

الملخص:
يهدف البحث إلى بيان المنهج الفقهي للإمام الجويني في كتابه (نهاية المطلب في دراية المذهب)، وذلك من خلال التعريف به، وبكتابه، ثم تحليل نصوصه؛ لتلمس أهم المعالم التي تميزها، والتي تصوغ منهجه الفقهي في العرض والاستدلال، والتعامل مع المخالف، وعنايته بالألفاظ ودلالاتها، وإبراز المنهج البحثي الدقيق الذي يُمكن أن يكون أساسًا للبحوث العلمية الشرعية، ومكانته وأثره في الفقه الشافعي، ويعتمد البحث على المنهج الاستقرائي التحليلي في العرض والاستدلال في تحقيق المذهب، والحرص على بيان الحق ولو خالف، قسمت البحث إلى تمهيد وخمسة مباحث: التمهيد: فيه نبذة عن المؤلف، وأهمية الكتاب، وسبب تأليفه، وتحت كل مبحث مجموعة من المطالب التي تحوي معالم المنهج الفقهي للإمام الجويني التي امتاز بها في كتابه، وحرصتُ على ذکر الأمثلة التي توضحها.
Abstract :
The research aims to explain the jurisprudential approach of Imam Juwayni in his book (The End of the Demand in the the Knowledge of Doctrine, This is done by introducing him, his book, and then analyzing his texts to touch the most important landmarks that distinguish them, which formulate his jurisprudential approach to presentation and reasoning, dealing with the violator, and his attention to words and their connotations, Formulate his jurisprudential approach in presentation and reasoning, dealing with the violator, taking care of words and their connotations, highlighting the accurate research method that can be the basis for forensic scientific research, and its status and impact on Shafi'i jurisprudence, The research depends on the inductive analytical approach in the presentation and reasoning in the realization of the doctrine, and keenness to clarify the truth even if it is contrary. I divided the research into a preface and five topics: The preamble: It contains an overview of the author, the importance of the book, and the reason for its authorship.
