قتلُ الأسير المسلم نفسَه خشيةَ كشفِ الأسرارِ [دراسةً فقهيَّةً مقارنةً]

إنَّ مسألة قتل الأسير المسلم نفسه خشية كشف الأسرار؛ من المسائل الشائكة والعويصة، والتي يتجاذبها أصلان؛ أولهما: تحريم قتل النفس، وثانيهما: دفع كبرى المفسدتين بارتكاب أدناهما، وللعلماء المعاصرين فيها خلافٌ شديدٌ، واجتهادات، فمنهم مَن يُحرّمه مطلقًا، ومنهم مَن يرى ذلك مِن باب التلجئة والضرورة. وهذه المسألة الشائكة تُعَدّ من نوازل العصر المستجدة التي لا يوجد بشأنها نصٌّ صريحٌ من الكتاب أو السنة، بل ولم أجدها في كتب الفقهاء المتقدمين، فلم يُنقل عنهم في جواز الانتحار خوف إفشاء الأسرار، ولا في عدم جوازه نصٌ صريحٌ في كتب الفقه، وإنما وجدتُ اجتهادات للفقهاء المعاصرين فيها، تتساوى فيها قوة الحجة والأدلة مما صعَّبَ عليَّ الأمر في ترجيح القول فيها، والتوصل إلى حكم الله تعالى فيها. وقد قمتُ بتحديد بعض المفاهيم والمصطلحات الخاصة بالبحث كقتل النفس عمدًا، والانتحار، وحكم قتل النفس، ثم قمتُ ببيان المسألة محل البحث مباشرةً وسردتُ أقوال الفقهاء المعاصرين فيها بصورة مفصَّلة، وأدلتهم، والمناقشات التي وردت على هذه الأدلة، واختتمت البحث ببيان حكم السعي في فكاك الأسرى في الفقه الإسلامي، وأسأل الله التوفيق والسداد، وهو حسبي ونعم الوكيل.

Contemporary scholars have a strong disagreement and jurisprudence regarding it. Some of them prohibit it absolutely, and some of them see it as a matter of resort and necessity. This thorny issue is considered one of the emerging calamities of the era about which there is no explicit text from the Book or the Sunnah, and even I did not find it in the books of the earlier jurists, and it was not reported from them that suicide is permissible for fear of revealing secrets, nor is it impermissible an explicit text in the books of jurisprudence, but I found jurisprudence Contemporary jurists in it, the strength of the argument and the evidence is equal, which made it difficult for me to prefer the saying in it, and to reach the judgment of God Almighty in it.I defined some of the concepts and terminology of the research, such as intentional killing of oneself, suicide, and the ruling on killing oneself, then I clarified the issue in question directly and listed the sayings of contemporary jurists on it in detail, and their evidence, and the discussions that were received on this evidence, and I concluded the research with a statement of the ruling on seeking to free the prisoners. In Islamic jurisprudence, I ask God for success and payment, and He is sufficient for me and He is the best disposer of affairs.
