الملخص:
الحديث عن مناهج الفقهاء في کتبهم من الموضوعات المهمة لطلبة العلم؛ وذلک لمعرفة طريقة الفقهاء في استنباط الضوابط الفقهية، وصياغتها، والاستدلال بها، مما يعين الباحث على فهم المسائل وتبسيطها والتوصل إلى الحکم الشرعي بمنهجية علمية واضحة. ويعد کتاب (بدائع الصنائع في ترتيب الشرائع) للإمام علاء الدين الکاساني من الکتب المعتمدة في المذهب الحنفي، فقد اعتنى به الإمام الکاساني عناية خاصة، واهتم بذکر الأصول والقواعد والضوابط والأحکام الشرعية، وتخريج الفروع عليها، ولأهمية الکتاب ومؤلفه، ولمعرفة المنهج المُتبَع في استخراج الضابط الفقهي عند الإمام الکاساني ‌، أحببت أن أقدم دراسة لمنهجية الإمام الکاساني في الضوابط الفقهية، من خلال کتاب (بدائع الصنائع في ترتيب الشرائع)، استقراء من (کتاب الغصب، والإکراه، والمأذون، والإقرار)، وقد قسمت البحث إلى ثلاثة مباحث: المبحث الأول: ترجمة موجزة عن الإمام الکاساني ومؤلفه، وفيه ثلاثة مطالب:الأول: اسمه، ولقبه، ونسبه، ومولده، ونشأته، ووفاته، الثاني: العوامل التي أثرت في علميته، الثالث: التعريف بکتاب (بدائع الصنائع) وقيمته العلمية، المبحث الثاني: التعريف بالضوابط الفقهية، وفيه مطلبين: الأول: التعريف بالضوابط الفقهية باعتبارها مرکبا اضافياً وباعتبارها علماً أو لقباً، الثاني: الفرق بين الضابط والقاعدة، المبحث الثالث: منهج الإمام الکاساني في صياغة الضوابط، وفيه مطلبين: الأول: منهج الإمام الکاساني في التأصيل والاستدلال للضابط، الثاني: منهج الإمام الکاساني في صياغة الضابط، وقد کان المنهج المتبع في البحث منهج الاستقراء والاستنباط، وکانت من أهم النتائج التي توصلت لها: جهود المذهب الحنفي في التقعيد الفقهي والتأليف فيه، فقد کان لهم قدم السَّبْق في التأصيل لهذا العلم بمؤلفات علمية کانت کحجر الأساس لمن بعدهم من الفقهاء والعلماء، إضافة إلى ذلک ما تميزت به صياغة الإمام الکاساني للضوابط بعبارات محکمة المباني، مؤدية المعاني، واعتماده في تأصيله للضابط والاستدلال له على المصادر الشرعية من کتاب وسنة وغيرها.

Abstract:
Discussing jurists' methods in their books is significant for students. To know jurists' methodology in deducing jurisprudential controls, formulating them, and inferring them, helps the researcher to understand and simplify issues and reach the canon ruling with a logical scientific methodology.
Imam Alaa al-Din al-Kasani's book (Bada'i' al-Sana'i fi Tarteeb al-Shari') is one of the books approved by the Hanafi doctrine. Imam Al-Kasani took special care of it. He noted fundamentals, rules, controls, canon rulings and how sub-issues are ruled. Due to the importance of the book, its author and the Imam's approach to extracting the jurisprudential discipline, I decided to present a study of his methodology. Badaa'i Al-Sana'i fi Tarteeb al-Shari'), extrapolated from (The Book of Extortion, Compulsion, Authorization, and Admission) I divided the research into three sections: The first section: a brief biography of Imam Al-Kasani and introduces his book. It has three parts: the first: his name, surname, lineage, birth, upbringing, and death, the second: the factors that affected his science, the third: introducing his book (Bada'i' al-Sana'i) and its scientific value. The second section: the definition of jurisprudential controls, has two parts. The first: Defining the jurisprudential controls as an additional compound and as a science or title. The second: The difference between the control and the rule. The third section: Imam al-Kasani's approach in formulating the controls. It has two parts. The first: Imam al-Kasani's approach in rooting and inferring the controls. The second: Imam al-Kasani's approach in formulating the control The method followed in the research was the method of induction and deduction. Among the most significant results it reached: Showing the Hanafi school of jurisprudence efforts and authorship in jurisprudence principles. They had the first precedent in conceptualizing this science with scientific books that were the cornerstone for the jurists and scholars who came after them. Additionally, meaningful well-composed terms characterized Imam Al-Kasani's formulation of the controls. He relied on legitimate sources of the Qur'an, Sunnah, and others to authenticate and deduce controls.
