قرينة الأشعة الطبية ودورها في إثبات عيب الأمراض التناسلية في النکاح دراسة فقهية"

الملخص :
في هذا العصر الحديث يُرى الکثير من المستجدات والنوازل التي لم تکن معلومة من قبل، حيث شهد العالم تطوراً علمياً کبيراً، ومع هذا التطور کانت للشريعة أحکامها ,وضوابطها لمعالجة ما يستجد علينا من المستجدات ,مبنية على أسس متينة من العلم ,والقواعد المحکمة ,والأحکام الشرعية الواضحة ومن جملة المسائل التي استجدت في هذا العصر القرائن الطبيـة , والتي کان لها دور کبير في الإثبات, ومن هذه المستجدات قرينة الأشعة الطبية  وجاء هذا البحث لبيان حقيقة الأشعة الطبية , وبيان دورها في الإثبات ؛ کقرينة طبية معاصرة , وذلک في إثبات الأمراض التناسلية لدى الزوجين, ومدى أثر هذه القرينة الطبية المعاصرة على عقد الزوجية. و قرينة الأشعة الطبية قرينة" عقلية" يمکن إدراکها من الواقع بالعقل, وهي أيضاً قرينة "قضائية" يمکن للقاضي استنباطها من الوقائع الحوادث الحاصلة, وقد تکون قرينة قاطعة, وقد تکون قرينة مرجحة , وقد تکون قرينة ملغاة لا اعتبار لها. أوصي الباحثين بمزيد من الاهتمام في بحث القرائن الطبية المعاصرة, لاسيما ما يتعلق بقرينة الأشعة الطبية. وأوصي الجامعات بإقامة برامج علمية متعمدة تهتم بموضوع القرائن عامة والقرائن الطبية خاصة ,ليستفيد منها طلبة العلم والقضاة والعاملين في الطب الشرعي وغيره من المجالات.
Abstract :
In this modern era, many developments and calamities are seen that were not known before, as the world witnessed a great scientific development, and with this development, sharia had its provisions and controls to deal with what is emerging on us of developments, based on solid foundations of science, court rules, and legal rulings. The clear and among the issues that have arisen in this era are the medical evidence, which had a great role in the proof. Among these developments is the evidence of medical radiology. This research came to clarify the reality of medical radiology, and its role in proof. As a contemporary medical presumption, in proving venereal diseases in spouses, and the impact of this contemporary medical presumption on the marital contract. And the presumption of medical x-rays is a “mental” presumption that can be understood from reality with the mind, and it is also a “judicial” presumption that the judge can deduce from the incidents that occurred. I recommend that the researchers pay more attention to the research of contemporary medical evidence, especially what is related to the presumption of medical radiology. I recommend universities to establish deliberate scientific programs concerned with the subject of evidence in general and medical evidence in particular, for the benefit of science students, judges and workers in forensic medicine and other fields.
