معالم منهج البحث الفقهي والعلمي عند الإمام الجويني من خلال کتابه: ( نهاية المطلب في دراية المذهب )

الملخص :
قد بذل المجتهدون والفقهاء من هذه الأمة وسعهم في استنباط الأحکام وجمعها وإيضاحها، وتوالت بذلک خدمة هذا العلم الجليل عصراً بعد عصر، وبرز في خضم ذلک مصنفات وأعلام منها: کتاب (نهاية المطلب في دراية المذهب) للإمام الجوينيّ في المذهب الشافعيّ, وهذا الکتاب له منزلة وأهمية في المذهب لما حوى بين دفتيه من منهج مميز سار عليه مصنفه فيه, ولما للمناهج التي سار عليها علماؤنا السابقون من أثر کبير ونتيجة عظيمة في تطور البحث في الفقه الإسلامي, فقد اخترت موضوع (معالم منهج البحث الفقهي والعلمي عند الإمام الجويني من خلال کتابه: (نهاية المطلب في دراية المذهب) استقراء وتطبيق من کتاب "الوديعة" إلى کتاب "النکاح" ) وخرجت منه بمعالم منها ما هو مختص بمنهج البحث الفقهي, ومنها معالم علمية وموضوعية عامة, وحرصت على ذکر الأمثلة والتطبيقات التي توضحها. وقسمت البحث إلى ثلاثة مباحث: المبحث الأول: التعريف بالإمام الجويني وکتابه(نهاية المطلب) ومعالم منهجه العام المذکورة في مقدمته, وفيه أربعة مطالب: الأول : التعريف بالإمام الجويني. والثاني: التعريف بکتاب ( نهاية المطلب ). والثالث: معالم منهج الجويني العامة المذکور في مقدمة الکتاب. والرابع: المصطلحات التي استخدمها الإمام الجوينيّ في کتابه (نهاية المطلب). المبحث الثاني: المعالم العامة في منهج البحث العلمي عند الإمام الجويني, وفيه مطلبان: الأول: معالم منهج الجويني في عرض المعلومات وترتيبها, والثاني: معالم منهج الجويني في استخدام اللغة. المبحث الثالث: المعالم الخاصة بمنهج البحث الفقهي عند الإمام الجويني, وفيه ثلاثة مطالب: الأول: معالم منهج الجويني فيما يتعلق بتأصيل المسائل وبناء الأحکام, والثاني: معالم منهج الجويني في عرض الآراء ومسائل الخلاف, و الثالث: معالم منهج الجويني في مناقشة الآراء ومسائل الخلاف.هذا وقد کان المنهج المتبع في البحث المنهج الوصفي التحليلي. وکانت من أهم نتائج البحث: إبرازه لشخصية الجوينيّ (رحمه الله) وما تميّز به من الاستقلاليّة والدقة والأمانة والإضافات العلميّة الثريّة وغيرها, وهي من أکثر ما نحتاج إلى وجوده في الباحثين المعاصرين, إضافة إلى أنّ في المعالم المنهجية التي تم ذکرها أجوبة واضحة على الأسئلة والمشکلات في منهج البحث الفقهي والعلمي في أيامنا هذه. وفي ختام البحث کان التأکيد على ضرورة توجيه طلبة العلم والباحثين إلى إبراز الصورة المشرقة للمنهجية العلمية والأدبية لعلمائنا الأجلاء والاهتمام باستقراء کتب أئمة الفقه للخروج منها بحصيلة علمية وفکرية ولغوية تثريهم في اختيار موضوعات لأبحاثهم, وتصقل ملکاتهم عند إعدادها, بل وتثريهم من الناحية الأخلاقية والاجتماعية.
Abstract:
The mujtahids and jurists of this nation have exerted their utmost in deriving the rulings, collecting them and clarifying them, and thus the service of this noble science continued, era after era, and in the midst of that, works and figures emerged, including: The book (Nahayat al-Muttalib fi Daraa al-Madhahb) by Imam al-Juwayni in the Shafi’i school, and this book has a status And the importance of the madhhab because it contained a distinctive method that his work followed in it, and because of the methods followed by our previous scholars of a great impact and a great result in the development of research in Islamic jurisprudence, I chose the topic (the features of the method of jurisprudential and scientific research according to Imam al-Juwayni through his book: (End of the requirement in the knowledge of the doctrine) extrapolation and application from the book “The Deposit” to the book “Marriage”) and I came out of it with features, some of which are specialized in the method of jurisprudence research, including scientific and objective features in general, and I was keen to mention the examples and applications that clarify them. The research was divided into three sections: The first topic: introducing Imam al-Juwayni and his book (Nahayat al-Muttalib) and the features of his general curriculum mentioned in its introduction, and it includes four demands: The first: introducing Imam al-Juwayni. The second: the introduction of the book (Nahyat al-Muttalib). The third: the general features of Al-Juwayni’s approach mentioned in the introduction to the book. And the fourth: the terms used by Imam al-Juwayni in his book Nihayat al-Muttalib. The second topic: the general features of the scientific research method of Imam Al-Juwayni, and it contains two demands: the first: the features of Al-Juwayni’s approach in presenting and arranging the information, and the second: the features of the Al-Juwayni approach in the use of language. The third topic: the features of the approach of jurisprudence research according to Imam Al-Juwayni, and it contains three demands: the first: the features of Al-Juwayni’s approach in relation to the rooting of issues and the construction of rulings, the second: the features of the Al-Juwayni approach in presenting opinions and issues of disagreement, and the third: the features of the Al-Juwayni approach in discussing opinions and issues of disagreement The method used in the research was the descriptive analytical method. One of the most important results of the research: highlighting the personality of Al-Juwayni (may God have mercy on him) and what was distinguished by him in terms of independence, accuracy, honesty, and rich scientific additions, among others, which are among what we most need in contemporary researchers, in addition to the fact that the methodological features mentioned are clear answers to questions and problems In the methodology of jurisprudence and scientific research in our days. At the conclusion of the research was the emphasis on the necessity of directing science students and researchers to highlight the bright image of the scientific and literary methodology of our distinguished scholars and interest in extrapolating the books of the imams of jurisprudence to get out of them a scientific, intellectual and linguistic outcome that enriches them in choosing topics for their research, and refines their faculties when preparing them, and even enriches them morally and socially.
