قسمة المهايأة

الملخص :
تعتبر قسمة المهايأة من أفضل الوسائل والطرق التي يتم من خلالها الانتفاع بالمال الشائع، والتي تتم من خلال انتفاع کل شريک بجزء من المال الشائع مدة معينة، وهذا ما يسمى بقسمة المهايأة المکانية، أو من خلال انتفاع کل شريک بالمال الشائع کله مدة معينة، وهذا ما يسمى بقسمة المهايأة الزمانية.
وقد قسمت البحث إلى مقدمة وثلاثة مباحث وخاتمة.
أما المقدمة ففي أهمية البحث وأسباب اختياره، وأهدافه، ومنهجه، وخطته.
وأما المبحث الأول: ففي ماهية القسمة، وتناولت فيه: تعريف القسمة ومشروعيتها، ورکن القسمة وسببها وشرط لزومها، وأنواع القسمة.
وأما المبحث الثاني ففي ماهية قسمة المهايأة، وتناولت فيه: تعريف قسمة المهايأة، ومشروعيتها، ومحل قسمة المهايأة، وأنواع قسمة المهايأة.
وأما المبحث الثالث: ففي التکييف الفقهي لقسمة المهايأة والآثار المترتبة عليها، وتناولت فيه: التکييف الفقهي لقسمة المهايأة، وصفة قسمة المهايأة، وانقضاء قسمة المهايأة.
وأما الخاتمة ففي أهم النتائج والتوصيات .
Abstract :
The adapter division is considered one of the most important means by which common money is used, which is through the use of each partner with apportion of the common money for a certain period, which is called the division of the temporal adapter.
The research was divided into an introduction, three sections and a conclusion.
As for the introduction, it is about the importance of research, the reasons for choosing it, it is objectives, it is methodology and it is plan.
As for the first topic, it deals with what is the division, and I dealt with it, the definition of the oath and it is legality, the cornerstone of the division.
As for the second topic, on what is the adapter division, I dealt with the definition of the adapter division, it is legality, the location of the adapter division.
As for the third topic, it deals with the jurisprudential conditioning of the adapter division, and the implications thereof, and it dealt with:
Juristic adaptation of the adapter division, description of the hydration division, and the expiration of the adapter division. 
As for the conclusion, it is the most important findings and recommendations.
