حکم استثمار أموال الوقف في المشاريع القومية (دراسة فقهية مقارنة)

الملخص :
إن الدارس للحضارة الإسلامية يقف معجباً کل الإعجاب بدور الأوقاف في المساهمة في صناعة الحضارة الإسلامية ، والنهضة الشاملة للأمة ، فيعد الوقف أحد المنجزات التشريعية لتحقيق التکافل الاجتماعي ، وتأمين المصادر المالية لأعمال الخير ، ومن ثم فهو يمثل أحد معالم الحضارة الإسلامية ؛ لأنه يجمع بين التنظيم الدنيوي ، والحرص على استمرار الثواب الأخروي ، وذلک لاستفادة الأجيال المتلاحقة منه باعتبار أن آلية الوقف تعتمد على المحافظة على رأس المال ،وصرف النماء والربح للموقوف عليهم في مختلف وجوه البر والخير ، وإن من يقرأ تاريخ الوقف يجد أنه شمل مختلف جوانب الحياة من الجامعات والمستشفيات ، إضافة إلى الأوقاف الخاصة بالحيوانات ، مثل : (خيول الجهاد) التي لم تعد صالحة للاستعمال ، فحينئذ تحال إلى المعاش وتصرف لها أعلافها ، وما تحتاج إليه من هذه الأوقاف ، لذلک فإعادة دور الوقف تعني إعادة دور کبير للجانب التطوعي المؤسسي لخدمة الحضارة والتقدم ، ولخدمة تنمية المجتمع وتطويره .
Abstract :
The student of Islamic civilization stands fully admiring the role of endowments in contributing to the manufacture of Islamic civilization and the comprehensive renaissance of the nation, so the endowment is one of the legislative achievements to achieve social solidarity and secure financial resources for charitable work, and then it is one of the features of Islamic civilization. Because it combines worldly organization and concern for the continuation of the eschatological reward, in order for successive generations to benefit from it, given that the endowment mechanism depends on preserving the capital, and spending the growth and profit of those arrested in various aspects of righteousness and goodness, and whoever reads the history of the endowment finds that it includes various aspects of life From universities and hospitals, in addition to endowments for animals, such as: (jihad horses) that are no longer suitable for use, then they are referred to a pension and their feed is disbursed to them, and what they need from these endowments. Therefore, restoring the endowment role means restoring a great role to the institutional volunteer side to serve civilization And progress, and for the service of community development and development.
