وسائل المحافظة على البيئة في الفقه الإسلامي والنظام

الملخص :
وتعد مشکلات البيئة من المشکلات التي تواجه مستقبل البشرية جمعاء، ولهذا أصبحت قضية المحافظة على البيئة وآليات حمايتها محور اهتمام عالمي ووطني، فضمان مستقبل آمن للأجيال القادمة يتحتم معه الحفاظ على البيئة من أجل بقائها وأمانها للأجيال القادمة خالية من التلوث فالحق في بيئة سليمة أحد حقوق الإنسان الأساسية فالله سبحانه وتعالي قال في کتابه العزيز " إنا کل شيء خلقناه بقدر"  ودافع الاسلام عن البيئة وأکد على حمايتها من قبل ولي الامر.
وقد وضع الاسلام قواعد وأحکام للحفاظ علي البيئة أرضاً وسماءً وهواءً وماءً حتى تظل مصدر خير وفير واستقرار وسعادة لهذا الانسان في کل زمان ومکان، وترجم الفقه الاسلامي هذه القواعد والأحکام إلي ممارسات عملية، وفى المقابل يتم سن الأنظمة الهادفة الى حماية البيئة ومکافحة التعدي عليها من قبل الجهات المختصة في الدولة حتى تحقق الحماية اللازمة الردع اللازم، وذلک من خلال سلطات الضبط الإداري ذات الاختصاص في هذا الشأن في حالة التعدي عليها.
Abstract :
Environmental problems are among the problems facing the future of all mankind, and that is why the issue of preserving the environment and its protection mechanisms has become a focus of global and national concern. To ensure a safe future for future generations, it is imperative to preserve the environment for its survival and safety for future generations free from pollution. The right to a healthy environment is a human right. In his dear book, God Almighty said, “We created everything with a measure.” Islam defended the environment and emphasized its protection by the ruler.
Islam has laid down rules and provisions for preserving the environment, land, sky, air and water so that it remains a source of abundant goodness, stability and happiness for this person at every time and place, and Islamic jurisprudence has translated these rules and provisions into practical practices, and in return, regulations aimed at protecting the environment and combating encroachment upon it are enacted by The competent authorities in the state in order to achieve the necessary protection and the necessary deterrence, through the administrative control authorities with jurisdiction in this regard in the event of infringement.
