يدور الحديث في هذا البحث حول مسألة مهمة تتعلق بأحد جوانب المعاملات، التي أولتها الشريعة الغراء اهتمامًا بالغًا من خلال نصوصها المحکمة وقواعدها العامة، وهذا بيِّن في اهتمام الفقهاء بجانب المعاملات المالية وغيرها، لاسيما وأننا نعيش في عصر شهد تطورًا کبيرًا في مجال الاقتصاد والتجارة، والذي استتبع بدوره استحداث أنواع من العقود والمعاملات، التي لم تکن معهودة من قبل، وتحتاج إلى بيان موقف الشرع منها، وتبصير الناس بأحکامها، ومن بين تلک المعاملات المستحدثة مسألة التعامل بالأسهم والسندات– موضوع هذا البحث- والذي فيه وقفت على حدود الأسهم والسندات، وأنواع وخصائص کل منهما، وبيان حقوق مالکي الأسهم، وکيفية إصدار السندات، وتجلية الأحکام الشرعية لکل نوع من أنواع الأسهم والسندات من خلال أقوال أهل العلم المعتبرين في هذا المجال.
وقد اتبع الباحث المنهج الوصفي التحليلي في تصوير المسائل الفقهية وتحليل أقوال الفقهاء وأدلتهم في المسائل محل البحث.
وقد توصل الباحث إلى عدة نتائج مضمنة في خاتمة البحث.


 
Abstract
Research Title: (Extent of legality of dealing with shares and bonds from the perspective of Islamic Jurisprudence).
In this research, we discuss an important issue related to one aspect of the transactions, which the shariah has paid great attention to through its texts and rules, This is evident in the interest of jurists in addition to financial and other transactions, Especially as we live in an era witnessed a major development in the field of economy and trade, which in turn entailed the development of types of contracts and transactions, Which have not been known before, and need to state the position of Sharia, including, and to clarify people's provisions, Among these new transactions is the issue of dealing with stocks and bonds - the subject of this research - Which showed the limits of shares and bonds, the types and characteristics of each, the statement of rights of shareholders, and how to issue bonds, and the disclosure of the legitimacy of each type of stock and bonds Through the words of the scholars considered in this area.
The researcher has followed the analytical descriptive approach in portraying the jurisprudential issues and analyzing the statements of jurists and their evidence in the issues discussed.
The researcher found several results included in the conclusion of the research.
